The question of making Hajj obligatory by visiting the Kaaba or performing Umrah is not valid. Hajj has nothing to do with seeing the Kaaba or performing Umrah. Hajj is obligatory only on the able-bodied person. Allaah says (interpretation of the meaning): وَلِلَِهِ عَلَى النَّاسِ حِجُّ الْبَيْتِ مَنِ اسْتَطَاعَ لَِلَيْهِ سَبِيْلًا. That is, those among the people who are able to reach there (Baitullah) are obliged to perform Hajj to this house for the sake of Allah. (Surah Al 'Imran: 96) The purpose of affordability is that during the Hajj season one needs to have an additional amount of property by which he can travel to and from Makkah by vehicle and is able to meet the expenses of those who are in charge of his care until he returns from Hajj. Thus, at present, visa and permission to perform Hajj are also included in the legal capacity of Hajj. Since there was no legal requirement for a visa in earlier times, if someone arrived in Makkah to perform Umrah during the months of Hajj, he would stay there for the rest of the day: there was no legal impediment to performing Hajj. For this reason, Fuqaha'i Keram considers such a person to be capable and says that Hajj is obligatory on him. But now that there is no opportunity to perform Hajj with an Umrah visa or to stay in Makkah until Hajj, Hajj will no longer be obligatory by performing Umrah even during the Hajj season. 4746214246
