A mosque cannot be built on that cemetery. Because, (a) the place is waqf for the cemetery. And it has to be done in the place for which the waqf has been waqf. It would not be permissible to do anything else. (B) It is not permissible to build a mosque or any other structure on the grave leaving it intact. It is forbidden to build anything on the grave in Hadith Sharif. Hazrat Jaber Ra. Said- It is not the Messenger of God, may God bless him and grant him peace, to salute the grave, and to worship him, and to have his son upon him. The Prophet (peace and blessings of Allaah be upon him) forbade limestone graves, sitting on them and building (anything) on them.
