Question
My uncle died a few days ago. (May Allah Ta'ala grant him Paradise) While he was alive, he intended to complete the work of his Akika along with the sacrifice in the coming Qurbani. But in response to the Lord's call, he passed away. Now his family members want Akika to be named after him in the upcoming sacrifice as per the wishes of the deceased uncle. The question is, in the eyes of the law, the dead person can be akika? Or will it be a sin to do Akika according to his wishes? 7713652799

There are some misconceptions in our society due to not understanding the reality of Akika. Aqeeqah is not an obligatory act. Rather it is desirable. There is reward in doing it in the right way, otherwise there is no sin. And Akikah is only for the living. There is no evidence from the Prophet (peace and blessings of Allaah be upon him) for aqeeqah in the case of a dead person. That's the decent thing to do, and it should end there. It is mustahab to do aqiqah. There are also some mustahab methods of realizing that mustahab. E.g.
- Akiqah is to be done on the seventh day after the child is born. عن أم كرز الكعبية قالت سمعت رسول الله -صلى الله عليه وسلم- يقول «عن الغلام شاتان مكافئتان وعن الجارية شاة • kurayila kabiyyaha she saw the Messenger of Allah said: I heard that the son and daughter of two sheep from ekaimanera From a goat (Akbika will give). (Sunan Abu Daud, Hadith No. 2638; Sunan Tirmidhi, Hadith No. 1513; Sunan Daremi, Hadith No. 197; Sahih Ibn Hibban, Hadith No. 5313; Musnad Abi Yala, Hadith No. 4 No. 1290)
- On that seventh day, the child had to shave his head and donate the same amount of money. On the authority of Samra ibn Jundab, the Messenger of God, may God bless him and grant him peace, said: “Every slave should be slaughtered. The Prophet (peace and blessings of Allaah be upon him) said: Aqeeqah is a mortgage for every boy, who will slaughter him on the seventh day, and shave his head, and name him. (Sunan Abu Dawood, Hadith No. 2640; Sunan Bayhaqi Kubra, Hadith No. 19046; Sunan Darami, Hadith No. 1989; Musnad Ahmad, Hadith No. 2006) On the authority of Ja'far bin Muhammad Hazrat Jafar bin Muhammad narrates from his father that his father said: Hazrat Fatima bint Rasul Sahih Hassan, Husain, Zaynab and Umm Kulsum weighed the hair and donated that amount of seedlings. (Muwatta Malik, Hadith No. 1839; Shuabul Iman, Hadith No. 7272; Sunan Bayhaqi Kubra, Hadith No. 19069)
- Two goats for a boy and one for a girl. Or cows, camels and buffaloes, having two partners for a boy and one partner for a girl.
- If you cannot do aqeeqah on the seventh day, do it on the fourteenth day. If not, it will be the 21st day. If that doesn't happen, it's still a way to get more involved with your child. However, in this case also, it is better to count the seventh day after birth and give the seventh day, said Fukbahaye Keram. On the other hand, the wife of Abd al-Rahman ibn Abi Bakr said that the son of Abd al-Rahman was a slave, but he said, "No, the sun is not enough for the slave, and the price is too high." Hazrat Umm Kurz said: A woman of Abdur Rahman bin Abi Bakr's family said: Abdur Rahman's wife gave birth to a son and we slaughtered a sheep on his behalf. Then Hazrat Ayesha (may Allah be pleased with her) said: This is the way, but the method is to give two equal goats on behalf of the son and one goat on behalf of the daughter (Akbika). Then cook it, but do not break its bones. Then he will eat it himself, feed others, and give alms. Akbika will do these things on the seventh day, on the fourteenth day if she is not able to do that, and on the twenty-first day if she is not able on that day. (Musnad Ishaq bin Rahhua, Hadith No. 1292)
- The importance of Akika does not remain after reaching adulthood. However, if someone has given, then it will be realized. (Fathul Bari, 9/72). Nowhere in the hadith is there any evidence of giving aqeeqah to a child after his death. That is why it should be avoided. Yes, if it is given for the purpose of thawab in Isal, then it is presumed that there is a chance.. Aqeeqah can be given by specifying a separate part with the sacrifice. But not good. It is better to perform aqeeqah on the seventh day.The above provisions are mentioned so that the provisions pertaining to Aqeeqah become clear. So understandably, there is no need to do akiqah for your dead uncle. Even if it is done, it should be done in a separate animal as a precaution, said Mufti Keram. Do not mix together in the sacrificial animal. (Fatawa Rahimiyah-10/72) 2944561585
