(1) The whole of the mosque, including the upper and lower floors, must be maintained as a mosque. So no madrasa or anything else can be established permanently above the mosque. However, the training of religious knowledge is part of the basic objectives and activities of the mosque. The Prophet (peace and blessings of Allaah be upon him) laid the foundation of religious education in the mosque. Therefore, the provision of necessary religious education in the mosque is consistent with the purpose of the Shariah. However, training in the mosque should be on a non-residential basis. Residential madrasas cannot be made permanent. If there is no separate arrangement for religious education in an area, such activities can be conducted in the mosque until a separate arrangement is made on a temporary basis. However, in this case, Ustaz, Talib Ilm and all concerned must abide by the respect and etiquette of the mosque. All manners of the mosque should be refrained from. At the same time, Muslims should refrain from all activities that interfere with prayers and worship, and if there is a system of religious education in the area, the residential system should be removed from the mosque. (2) The provision of the Shari'ah is to use the waqf land for the development of the mosque. It is the duty of the devout Muslims of the area to set up madrasas in the area for the purpose of religious education and initiation of the people of the area. There is no opportunity to establish a permanent madrasa in place of a mosque. However, if the additional land of the mosque is not used for the mosque now, then the house for the madrasa can be built there temporarily subject to the permission of the mosque authorities and the activities of the madrasa can also be conducted in it. However, the next time the place is needed for a mosque, it must be quickly vacated for the mosque. (3) The mosque is an independent waqf institution. And the instruction of the Shari'ah is that Mutawalli or his people will fulfill the purpose of the waqf. Therefore, Fuqahaye Keram said, the income of the mosque will be spent in the mosque sector. If the income of a mosque remains after paying all the expenses, then the remaining money can be used for the following works:
- To increase the salaries and allowances of Imam-Muazzin and Khadem in adequate and reasonable amount.
- To build a housing arrangement for them to live near the mosque so that they can serve the mosque in peace.
- To establish a standard and up-to-date library for the purpose of practicing and enriching the religious knowledge of the common devotees.
- To organize part-time religious learning for Muslims of all classes and professions for the purpose of propagating religious knowledge.
- To organize morning and afternoon maktabs for school going boys and school going girls in the area and to conduct it through adequate number of qualified teachers.. To make arrangements for the worshipers to be comfortable in performing prayers, itikaf and other acts of worship.. If the ayukhana of the mosque is inadequate or uncomfortable or it is not properly accommodated inside the space of the mosque, then adequate and comfortable arrangement of ayu-istinjar should be made by constructing separate buildings in the adjoining place. If there is a surplus of money after the implementation of such projects, it will be reserved for the possible construction-expansion and development work of the mosque in the future. It is possible to provide for possible future expenses - even if this amount of money is kept in excess, it is actually needed, it can be given to a nearby mosque. Even then, since religious training was included in the basic activities of the mosque, the authorities could spend a portion of the money on the madrasa sector if they wished.
